Assistance from the earliest stages
The first contact helps locate the detained person and arrange legal assistance. Let us know whether they are at a police station, a Guardia Civil station or court premises. If a relative calls, they can provide the information they have without having to recount everything that happened over the phone.
Legal assistance focuses on explaining your rights, preparing for your statement and attending the steps in which a lawyer must participate. As a general rule, you are entitled to a private consultation before giving a statement. That conversation allows you to ask questions and assess your options using the information available.
If the person is brought before a judge, legal assistance focuses on preparing for their appearance and assessing decisions about their custody status. Each step is explained in light of the proceedings and decisions in the case.
Your rights during detention
You must receive understandable information about the reasons for your arrest and your rights. You can remain silent, decline to answer particular questions and refuse to give evidence against yourself. Legal advice helps you understand how to exercise those rights in your situation.
You also have rights to have the person you choose informed of your detention, to a medical examination and, where applicable, to a free interpreter. Tell the staff responsible and your lawyer about any health or communication needs.
What to tell us when you get in touch
Your name and contact number, the municipality, the place of custody if you know it, the approximate time of the arrest and whether a statement is scheduled are enough. Also tell us which language you need assistance in. The practice provides assistance in Spanish, English and French.
There is no need to send a case file or describe sensitive details in your first message. The documents needed will be agreed once professional contact has been established.
